Administration of Pindan

On 18 May 2021, Ernst & Young has been appointed as administrator of the Pindan group of companies meeting the criteria for making a claim under an insurance policy relating to residential building works.

If you are a homeowner who has entered into a contract with any of the Pindan companies below and you have been issued with a Certificate of Insurance, for Residential Building Works, by QBE you may be covered.

Please refer to your QBE policy wording for more information regarding coverage under your policy.

Pindan companies impacted are as follows:

  • Pindan Constructions Pty Ltd (ACN 159 837 500; BC101770)
  • Pindan Contracting Pty Ltd (ACN 120 076 360; BC12373)
  • Pindan Homes Pty Ltd (former name Switch Homes Pty Ltd) (ACN 612 210 643; BC101771); and
  • Pindan Projects WA Pty Ltd (ACN 130 857 617; BC101769)

collectively referred to as Pindan.

No contract

Irrespective of whether a Certificate of Insurance has been issued to you by QBE, please note that if you have not entered into a valid contract with any of the Pindan companies there is no insurable event to which your QBE policy can respond.

Appliances outstanding claim

If you have paid the final payment under your contract and your appliances have yet to be installed, QBE may supply and install those appliances.

You need to submit a completed and signed claim form to QBE. We also require copies of the following documents to accompany your claim:

  • A complete copy of the Building Contract
  • Specifications and/or variations specific to appliances, and
  • Evidence, such as a receipt or bank statement, confirming final payment was made.

If the final payment has not yet been made, then you may be able to lodge an incomplete works claim with QBE.

Incomplete works claim

If you have signed a contract and works have commenced, you are entitled to make a claim with QBE. As circumstances may vary from one contract to another, a completed and signed claim form for non-completion accompanied by all necessary documents attached needs to be submitted to QBE.

The following documents are also required at the time of lodging your claim:

  • A complete copy of the Building Contract
  • Specifications
  • Any variations to the contract
  • Council approved floor, site, elevation and engineering plans
  • Receipts and/or bank statements evidencing all payments made under the contract to the contracting builder
  • Photos substantiating the stage of construction at the time your builder ceased construction.
  • Contract Balance Reconciliation

Works not yet commenced

If you have signed a contract, but works have not yet commenced, you may be entitled to claim a refund of your deposit paid to your builder under the contract.

Homeowners need to submit a completed and signed claim form to QBE. 

Copies of the following documents need to accompany the claim form:

  • A complete copy of the Building Contract, and
  • Evidence, such as a receipt or bank statement confirming payment of the deposit.

Defects claim

QBE will assess and rectify any claim received for defects if a breach of statutory warranty has occurred, resulting in a loss.

Homeowners need to submit a completed and signed claim form to QBE. We require copies of the following documents to accompany your claim:

  • A complete copy of the Building Contract
  • Specifications
  • Any variations to the contract
  • Council approved floor, site, elevation and engineering plans, and
  • Evidence, such as a receipt or bank statement confirming that the final payment has been made.

To ensure an accurate assessment of your defect claim, we request that you provide a clear description under Section 8 of the claim form of each item being claimed. Should you have any photos of the items being claimed, please also attach them to your claim form.

Builders

QBE has contacts with preferred Builders in WA and are happy to provide these details to Claimants in the event that they need a builder to continue the works and/or rectify defects.

Question & answers

Q. Do I have to pay an excess?
A. Yes. As with most insurance policies, an excess does apply and in this case the applicable excess is $500.00. This amount is generally deducted at the time of settlement.

Q. I am due to pay the next progress payment. What should I do?
A. You may be obliged to pay for work that has been completed at the time Pindan Pty Ltd went into administration. The amount due, including any surplus, will be established during the claims process.
Please seek legal advice before making any further payments as any over payments to a contract could affect any potential settlement of an insurance claim.

Q. Can I get my own quote?
A. If you are lodging a claim, we encourage you to obtain your own quotations as this can speed up the claim process, however QBE is able to recommend some builders and/or supply your details to some builders so that they can contact you directly. A minimum of 2-3 quotations are required for comparison reasons.
